The journey began over 30 years ago with a Canadian cookie company. Monika initiated her legal career at Brown, Todd & Heyburn in Louisville, KY, where they represented Beatrice Foods in acquiring cookie companies across the United States. It was here that Monika's passion for drafting agreements took root. She continued honing this skill during her tenure at Jackson Kelly in Charleston, WV, and Dinsmore & Shohl in Charleston, WV. While many agreements are often generated from templates, Monika excels in commencing with a blank page, tailoring agreements to meet the specific needs and nature of the transaction for her clients. She skillfully weaves together legal provisions, always with a focus on intellectual property, creativity, thoroughness, and achieving the appropriate balance.
Following the enactment of the Uniform Adoption Act in West Virginia in the late 1990s, Monika, alongside her mentor David Barnette (partner at Jackson Kelly), compiled a comprehensive form book for adoptions. This resource was intended for Judges and attorneys to freely utilize. Ensuring that adoptions take place within the state in compliance with the law, without subsequent disputes or disruptions, was a significant priority for the attorneys involved. Since that time, Monika has provided legal representation for numerous adoptions, representing both birth parents and adoptive parents.
With the advancement of medical procedures, Monika's legal practice expanded into the realm of gestational surrogacy. Since 2001, she has provided legal representation for over 50 surrogacies, advocating for the interests of both gestational carriers and intended parents. Jaensson Law sees this practice as a valuable complement to its primary focus on intellectual property and business law, as it actively contributes to the fulfillment of families' aspirations for growth.
